5.1. When you the client, order any backing tracks from LMC, either tracks from the catalogue or custom tracks, you are not in fact purchasing the track, but simply a licence to use it in certain ways which are clearly laid out in this section.
5.2. You the client, are bound by international copyright laws at all times, and may not, for any reason, copy, rent or sell the backing tracks licences you have purchased from us to a third party.
5.3. Due to the nature of this licence, we cannot exchange returned backing tracks for credit or an alternative product and/or service.
5.4. You may use the tracks you order from us in live performance situations only.
5.5. You may not use the tracks you order from us in the production of any recorded media intended for sale and distribution without express permission obtained in writing from LMC..
6. Special Offers
6.1. LMC may, from time to time and at its absolute discression, choose to run special promotional offers on any of its Websites. Such offers are subject to withdrawl at any time and without any warning, even if advertising indicates a promotional campaign is in progress.
6.2. LMC reserves the right to restrict the use of promotional discount codes issued as part of any marketing campaign in any way, including but not limited to restricting the number of times a code may be used by an individual customer, only allowing 1 discount to be applied per order, or else only allowing first-time customers to use a code.
6.3. High-value customers may be entitled to a discount code to use for all purchases on a perminent basis. However, LMC reserves the right to withdraw such a discount, increase, reduce or suspend it at any time and without warning for any reason.
6.4. LMC reserves the right to restrict access to discount codes to specific individuals, customer groups or organisations at any time, and any attempt to share, republish, or otherwise mis-use such discount privollages may result in legal action being taken.
6.5. LMC reserves the right to withdraw its quantity-based global discount, increase, reduce or suspend it at any time, for any reason and without any warning. This might happen if certain discount codes are keyed in during check-out for example.

7.1. If any provision of these terms and conditions shall be unlawful, void or unenforceable for any reason then that provision shall be deemed severable and shall not affect the validity and enforceability of the remaining provisions.

Custom Products And Services Policy
9. Cancellations And Your Liabilities
9.1. If you the client, purchases a customised product and/or service from LMC, you enter into a non-cancellable contract with us, and will be liable to meet all costs in the event you breach this agreement in any way.
9.2. If you cancel your contract with us and you do so in a \"Timely Fashion\", LMC may consider a compromise with respect to any outstanding charges but we reserve the right to ask for payment in full in such circumstances.
9.3. LMC defines \"Timely Fashion\" as a date no more than half way through the \"Provision of Service Period\" as agreed by yourself and LMC.
9.4. The \"Provision of Service period\" is defined as the period from when you agree to our Terms And Conditions by submitting your details to us, and the date you are due to take delivery of your products and/or services.
9.5. In the event you should cancel your contract with us, you will be liable for all expenses incurred by LMC during the \"Provision Of Service Period\" up to that point regardless of what, if any, compromise is reached by you the client, and LMC, and this is not negotiable under any circumstances.
9.6. Any dispensations agreed to by LMC are offered entirely at our own discretion, and are not in forcible by UK law.
10. Refunds
10.1. If you elect to receive any LMC products and/or services electronically, i.e. via an FTP transfer, you automatically forfeit any rights to a refund once you access the storage area where your digital files are stored on our servers for the first time by logging in with a user name and password provided to you.
10.2. If you elect to receive your products on CD, you will have a period of seven days in which to contact us and return the CD if it is faulty, or if we have sent you the wrong CD in error. In such circumstances, we will be happy to send out a replacement CD, but you will not be eligible for a refund or an alternative product, even if it is of the same value.
10.3. As samples of any or all of the tracks you commission can be made available for you to listen to on our Website, dissatisfaction with the quality of your purchase(s) will not be considered grounds for a refund. A replacement can be provided if the quality of the recording you receive after payment is poor.
10.4. In the unlikely event that LMC is unable to complete all or part of your order, you will not be eligible for any charges accept for those relating to products and/or services you have already received. If you have made a payment but have not received your products and/or services from us, you must notify us immediately and we will look into the matter. If we are still unable to resolve the problem, you will be eligible for a full refund. If LMC is able to prove that your products were dispatched to you in a timely fashion but they have subsequently gone missing in the post or between our servers and your computer, we will be happy to provide a replacement as soon as possible, but you will not be entitled to a refund or alternative products or services.
11. Provision Of Service Expenses
11.1. You the client, will be eligible for all expenses incurred by LMC during the \"Provision of Service Period\" relating to your project, and these will be fully itemised for you on our official invoice or receipts provided.
11.2. The \"Provision of Service period\" is defined as the period from when you agree to our Terms And Conditions by submitting your details to us, and the date you are due to take delivery of your products and/or services.
11.3. Expenses may include any applicable licence fees, and physical media costs - CD, Mini-Disc, DAT tape etc.
Stock Items Policy
12. Cancellations And Your Liabilities
12.1. If you the client, makes a selection of backing tracks that LMC already has in it's catalogue, you may cancel your order at any time up until you receive either: A. Details on how to download your files from our server, B. A CD containing your backing tracks through the post.
12.2. In the event you should cancel your order with us, you will be liable for all expenses up to that point regardless of what, if any, compromise is reached by you the client, and LMC, and this is not negotiable under any circumstances.
12.3. Expenses may include rendering of your selected tracks to the digital hard-copy media of your choice - CD, Mini-Disc or any other digital hard-copy media current at the time of your order.
13. Refunds
13.1. If you elect to receive any LMC products and/or services electronically, i.e. via an FTP transfer, you automatically forfeit any rights to a refund once you access the storage area where your digital files are stored on our servers for the first time by logging in with a user name and password provided to you.
